Last week, President Trump took two actions to support Buy America. On Tuesday, the President signed an executive order instructing all federal departments and agencies to conduct comprehensive assessments aimed at strengthening the Buy America Program. The President wants to minimize waivers and exceptions that give foreign steel unfair advantages in government procurement. Notably, the President affirmed the “melted and poured” standard for domestic steel, as we and other supporters of Buy America have urged. The White House press release is here.
On behalf of the undersigned organizations, which represent the overwhelming majority of domestic steel and iron producers and their workers, we write to express our absolute and unqualified support for Buy America domestic procurement preferences in U.S. law. Together, as the iron and steel backbone of our nation’s infrastructure, we stand ready to work with you to strengthen our nation’s Buy America laws, create manufacturing jobs, and rebuild America.

On October 18, 2016, the Federal Highway Administration (FHWA) issued a notice proposing two nationwide waivers from the Buy America Program. The first would be a permanent waiver for Commercially Available Off-the-Shelf (COTS) products with steel or iron components. The second would be a one-year waiver for steel tie wire permanently incorporated in precast concrete products. In addition to these two proposed waivers, FHWA announced that it is considering whether to issue a nationwide waiver for specialized lifting devices incorporated in precast concrete products.
